Limited Edition Prepaid Internet Terms & Conditions

The terms and conditions herein govern the use of Internet and shall be applicable only to Limited Edition Prepaid Internet customers (hereinafter referred to as 'Customer').

Internet usage refers to Customer's access to the Internet via DiGi Telecommunications Sdn Bhd’s ("DiGi") data network eg. GPRS, EDGE or 3G (whichever is applicable).

DiGi does not guarantee or warrant the availability of the Internet connection and the Customer(s) acknowledges and agrees that the Internet connection is provided on an "as is" basis.

DiGi reserves the right to revise, modify and/or change these terms and conditions at any time at DiGi's sole discretion without providing notice to Customers. Continued use of this service following any changes to these terms and conditions constitutes an acceptance to those changes (if any). Customers are advised to visit this page periodically to review the terms and conditions.

Limited Edition Prepaid Internet does not take into consideration any free Internet usage (in kilobyte) and/or Free Talktime (in RM) granted to Prepaid Customer(s) at any point of time.

Limited Edition Prepaid Internet is optimised for Internet browsing and it is not intended for peer-to-peer or file sharing applications. DiGi reserves its absolute right and discretion to apply the
Fair Usage Policy if the Customer is suspected to have had abused the Internet usage in whatsoever way including exceeding the fair usage limit of 100MB per day wherein DiGi may throttle the speed or block the Customer’s Internet usage.

DiGi does not warrant or guarantee the delivery of the SMS notification to Customer(s).

Limited Edition Prepaid Internet shall not be applicable to Customer(s) roaming on other domestic or international networks.

Once the Customer subscribes to Limited Edition Prepaid Internet, the Customer is not allowed to change plan to other DiGi Prepaid, DiGi Postpaid Plan or Porting out to different telecommunications service provider.

10.

Limited Edition Prepaid Internet is not applicable for Porting In from another telecommunications service provider.

11.

All other terms and conditions governing the use of Prepaid Customers in relation to the utilisation of Limited Edition Prepaid Internet shall apply herein mutatis mutandis.

12.

Limited Edition Prepaid Internet is used solely for data access purposes. There are no voice capabilities, MMS, Talk time Transfer and outgoing SMS services on Limited Edition Prepaid Internet SIM Card.

13.

Limited Edition Prepaid Internet SIM Card is not applicable for Reload Bonus and Birthday Bonus or any loyalty campaign as per current voice DiGi prepaid customers.

14.

Charging of this data plan is based on the reload validity. DiGi reserves the right to change such charging block without prior notice to the Customers.

15.

The Limited Edition Prepaid Internet SIM Card must be reloaded upon expiry of the validity; failing which all Internet access will be blocked.

16.

Detailed instructions on how to reload the value of Limited Edition Prepaid Internet SIM Card can be found in the user guide.

17.

Every Limited Edition Prepaid Internet SIM Card, once sold, is not refundable. DiGi is not obliged to refund, and will not entertain any claim for any refund of, any unused portion of the value of Limited Edition Prepaid Internet SIM Card whether before or after its expiry.

18.

Every Customer is fully responsible for the use of Limited Edition Prepaid Internet SIM Card and DiGi shall not be liable in any circumstances for any losses, expenses, damages, claims, liabilities or costs suffered or incurred by the Customer resulting from the failure by the customer to do so.

19.

DiGi makes no warranty, express or implied, with respect to the services provided under the Limited Edition Prepaid Internet SIM Card and expressly disclaims any warranty of merchantability, description or fitness for any particular purpose or function.

20.

DiGi reserves the right to change the Fair Usage Policy.

21.

DiGi reserves the right to revise these terms and conditions (including pricing) at its discretion without prior notice.

22.

The use of the Limited Edition Prepaid Internet SIM Card will constitute acceptance of these Terms and Conditions and / or any amendment.

23.

The use of the Limited Edition Prepaid Internet SIM Card will be subject to :-

• Limited Edition Prepaid SIM Card general Terms and Conditions
• Limited Edition Prepaid Internet Reload Coupons Terms and Conditions
• Fair Usage Policy.

24.

Each Limited Edition Prepaid Internet SIM Card is fully transferable, non refundable and must be activated before the use by date printed on it.

25.

If we cancel the service as a result of your breach, all unused validity in your account will be forfeited.

26.

You are responsible for all costs and losses resulting from any use of the Limited Edition Prepaid Internet SIM Card and which arises prior to any lost and stolen case.

27.

In the event of any loss or stolen SIM card, DiGi will not be liable or obligated to refund or replace any remaining credit balance or validity, the SIM card itself or your mobile phone number.

Limited Edition Prepaid Internet Reload Coupons Terms & Conditions

For the purpose of this Plan, the reload validity will be based on validity as stated in the user guide and not the validity period as stated on the back of your reload coupon.

The validity period of reloads purchased from alternate channels will be the same as the regular reload coupons.

Every time you reload, your SIM Card will compare the remaining validity period with the validity period of your new reload. The higher of two validity periods will take effect.

Reload coupons that have passed the expiry date printed on them will not be usable and/or returnable.

Reload coupons are not refundable. Any value that has been reloaded is not transferable or refundable. DiGi will not be liable for any loss or damage due to reloading errors caused by the user of the reload coupon.

DiGi reserves the right to forfeit any remaining credit after the expiry period of the respective validity period.

Any reload performed using any of the alternate reload channels outlined in the user guide or via any other channel which may be added from time to time will be subjected to their own respective terms and conditions that are not governed by DiGi.

Flexi e-load is not allowed for this data plan.

Limited Edition Prepaid Internet SIM Card general Terms and Conditions

DiGi Prepaid customers are not entitled for the DiGi Guarantees.

It is DiGi's policy to respect the privacy of its customers and take the issue of privacy seriously. DiGi will not monitor, edit, or disclose any personal information about you or your use of the Service, including its contents, without your prior permission unless DiGi in good faith believes that such action is necessary to:

a) conform to legal requirements or comply with legal process;

b) protect and defend the rights or property of DiGi;

c) provide relevant part of the Service; or

d) act to protect the interests of its customers or others.

You agree that DiGi may access your account, including its contents, as stated above or to respond to service or technical issues.

All applicable taxes, levies and/or duties are payable by you. You must reimburse DiGi on demand for any such expenses which it is obliged to pay on your behalf.

Any information stipulated in this website or any medium which may be referred to from time to time will be considered to constitute part of the Terms and Conditions as contained herein.

DiGi is not liable to reimburse or compensate you for any damages, costs, expenses or loss arising from the expiration or the termination of the reload coupons or SIM Card.

DiGi and its officers, employees, agents and subsidiaries shall not be liable for any loss, damage, costs, personal injury or expenses suffered by you or any third party that arises directly or indirectly as a result of the following:

•	any act, omission, error, default or negligence on the part of DiGi or its business partners which shall not be limited to partners involved in providing/administering DiGi's alternate reload channels.
•	any loss, distortion or mutilation of data
•	unauthorised access or usage of the Service by any third party
•	the unavailability of any part of the Service as a result of any mobile phone, inter-network or data format incompatibility, or as a result of any issues pertaining to network coverage, the unavailability of the internet or any other medium related to or required to access or use the Services or as a consequence of any other reason whatsoever.
•	the nature, quality and/or effect of the Services and/or the related content

DiGi makes no warranty, guarantee or representation, expressed or implied regarding the condition, merchantability, availability or fitness of any part of the Service, any service/equipment provided by any third party that is necessary for the access and/or use of the services or for the quality of the DiGi network or that of any other telecommunications service provider.

You agree to fully indemnify DiGi if any fraud, misrepresentation and/or unauthorised or unlawful use of the Service by you, your agents, representatives or employees result in any loss, damage, costs or expenses to DiGi.

These Terms and Conditions will be governed by the laws of Malaysia.
