Personal Accident Insurance
 
Your Personal Accident ("PA") Insurance is subject to the following terms and conditions:
 
1. The terms and conditions herein governs the use of the PA insurance and shall be read together with the Individual Registration Agreement ("IRA") or the terms and conditions for prepaid subscribers, as the case may be.
   
2. The PA insurance offered by us is underwritten by Chartis Malaysia Insurance Berhad [formerly known as AIG General Insurance (Malaysia) Berhad] ("CMI").
 
3. Purchase of PA insurance
 
a. We shall upon receipt of your instruction from the available purchase channels to purchase any PA insurance, immediately create an e-money account for you and you agree that you shall be bound by the terms and conditions for e-money.
b. Upon successful purchase, you shall be bound by the terms and conditions herein and shall be read together with the terms and conditions of the Certificate of Insurance.
c. You are responsible to pay the premium for the PA insurance ("Premium") purchased.
d. The coverage period for your PA insurance is thirty (30) days upon successful purchase or renewal (as applicable).
e. We will try to charge the Premium upon expiry of your PA insurance coverage period on a recurrence basis via any Payment Method (as hereinafter defined) to extend your PA insurance coverage for another thirty (30) days until you cancel your PA policy or your PA policy is cancelled or terminated under the terms and conditions of the Certificate of Insurance or upon termination of your mobile account.
f. We shall use our best endeavour to remind you prior to the expiry of your PA insurance coverage period via an electronic channel.
g. Payment of Premium is based on either one of the following methods ("Premium Method"):
i. If you are a prepaid subscriber, by way of deducting your prepaid mobile phone airtime; or
ii. If you are a postpaid subscriber, by way of direct debit to your postpaid mobile phone account.
h. You are responsible to ensure:
 
i. If you are a prepaid subscriber, that there is sufficient airtime on your prepaid mobile phone account at all times; or
ii. If you are a postpaid subscriber, that your postpaid account is active at all times,
  in order for us to charge the Premium using the Payment Method stated in paragraph 3(e) above.
i. You may cancel your PA policy at any point of time by giving us instruction in the prescribed manner provided always that you are not entitled to a refund of any Premium paid and your PA insurance coverage shall continue until the expiry date.
j. Unless we obtain your instruction to cancel your PA policy, we shall upon the expiry of your PA insurance coverage period and within a grace period of one (1) day, try to renew your PA policy by using the Payment Method and:
i. if it is successful, the PA insurance coverage shall continue for a further thirty (30) days from the expiry date; or
ii. if it is unsuccessful, the PA insurance coverage shall be discontinued immediately,
in any event, we will at our best endeavour inform you of the status via an electronic channel.
k. You are not allowed to assign or transfer the PA policy and all and any Premium paid is not refundable in all circumstances.
l. The PA policy shall be cancelled or terminated based on any of the following reason:
i. in accordance to the terms and conditions of the Certificate of Insurance;
ii. if you transfer ownership of your mobile account;
iii. if your mobile subscription service is out of coverage or unavailable, suspended, or terminated for whatever reason; or
iv. if the status of your mobile account is restricted, suspended, or disconnected when we try to charge the Premium.
m. You are not allowed to carry forward the Premium (whether the full sum or the unused portion of the Premium) to a new mobile phone account.
n. If you are a postpaid subscriber under a commitment rate plan, and your total bill amount is equal to or less than the commitment fee, you understand that the service tax charged and payable on the billed amount is due to the commitment fee under your plan and is not due to a service tax on the Premium.
o. If there is any error in the insured's Personal Information (as defined below) or in the PA policy, your only option is to cancel the existing PA policy as per paragraph 3(i) and to purchase a new one.
   
4. Information
 
a. You can view your personal information provided to us in the Individual Registration Agreement (the "IRA") if you are a postpaid subscriber or at the time you register to be a prepaid subscriber ("Personal Information") on the website for the insurance service prior to your confirmation of purchase for the PA policy.
b. You are solely responsible to ensure that your Personal Information is correct at all times. DiGi shall not be responsible whatsoever for any inaccuracy in your Personal Information.
c. You must contact our Customer Service Centre or if required, to walk in to any of DiGi Centre in order for you to inform and/or update us as soon as you are aware of any error in your Personal Information or if there is a change to your personal information, as the case may be.
d. If your Personal Information on our website for the insurance service or the one provided to you prior to confirmation of purchase for a PA insurance policy is incorrect, you must, prior to completing the purchase transaction, submit the correct personal information, failing which, the details in the PA policy shall be accepted on an as-is basis.
e. You hereby expressly consent us to share the information necessary for purpose of the PA insurance policy.
   
5. Claims
 
a. All claims in relation to the PA insurance policy must be directed to CMI.

c. DiGi is not liable whatsoever under the PA insurance policy should you or the insured person omit or fail to observe or breach any of the terms and conditions in the Certificate of Insurance.
   
6. Others
 
a. Any failure by DiGi to enforce any of the terms and conditions herein shall not operate as a waiver of DiGi's rights contained herein.
b. By purchasing the PA insurance policy herein, you consent and allow us to use and/or disclose the information under the PA policy for any purposes deemed necessary including but not limited to marketing and promotion purposes of any other insurance products, or disclosure under the law or in compliance to any laws and regulations.
c. We reserve the right to use the information related to the PA insurance policy, publish any matter related thereto including but not limited to name and/or photograph(s) for any purpose whatsoever without the need to obtain prior consent from you or the insured person.
d. We shall not be held liable for any loss or damage suffered by you or any third parties arising from the purchase of the PA insurance policy.
e. We reserve the right to modify, vary, amend and/or delete any part or the whole of the terms and conditions herein without prior notice.
