1.1In this section, the Services refer to the data plans services provided by Digi from time to time which may be published and updated in Digi's website.
1.2Access and use of the Services shall also be subject to the terms and conditions which govern the Value Add Services, Postpaid Services and Prepaid Services.
1.3The effective date of each service may be varied at Digi's sole discretion without any prior notice to the Customer.
1.4Unless otherwise specifically waived by Digi, the Customer will be charged for the each of the Services the Customer subscribed and/or purchased. The total usage value utilized by Digi is system tabulated and is accurate at that point of time. This value excludes any delayed charges and will be used to determine the effective tariff tier for a particular service. The total usage determined by Digi is final and no correspondence shall be entertained.
2.Billing for Prepaid
2.1The Customer has to ensure that they have sufficient talk time credit in order to constantly accessing a particular service for prepaid subscriber. Digi shall not be liable for any loss/ damage/ costs or expenses arising from the Customer's failure to do so.
2.2The total usage value will be reset to zero on the first of the month or such other date at Digi's sole discretion.
3.Billing for Postpaid
3.1The Customer shall promptly pay the charges and fees for data usage as may be imposed by Digi and any increase in such fees and charges from time to time.
3.2Notwithstanding the above, Digi reserve the right to bar the Customer's usage of any of the Services in the event the Customer's service usage has exceeded the credit limit and/or the maximum charge allowable under the same billing period
4.1Acknowledge and agree that the total data usage determined by Digi is final and Digi is not responsible for the accuracy of information provided by any third party devices and/or software installed in the device used for the calculation of the data size via Digi's network.
5.1All or any part of the Services may be modified, withdrawn or supplemented by Digi unilaterally at any time without any prior notice to the Customer.
5.2Digi reserves the absolute right, without any liability, at any time, to change or alter any part of the Services (including discontinuing the Services) and/or the pricing structure of the Services at any time without any prior notice to the Customer.
5.3The Services is subject to network limitations and availability.
5.4Digi does not warrant the performance or suitability of the Customer's handset or device on any network other than Digi's network.
5.5Digi does not warrant the timeliness, accuracy and usability of the Services or that the Services will be error free.
5.6Digi reserves the right to vary, add or amend the Service or any of these Terms and Conditions without giving any notice or prior consent of the Customer.
5.7Digi shall not be liable in any manner whatsoever to any party for any claims, proceedings, loss, damage, costs or expenses of any kind whatsoever suffered or incurred as a direct or indirect result of the utilization of the Services. In addition to these Terms and Conditions, instructions and methods of using the Services is set out in www.digi.com.my.
5.8The Customer using the Services shall be subjected to the Terms and Conditions which governs the use of the Value Added Services, Postpaid and Prepaid terms and conditions and/or any other additional terms and conditions, guidelines or rules applicable to the Services which are and/or may be set out in www.digi.com.my from time to time. All such terms and conditions, guidelines or rules are hereby incorporated by reference into this Terms and Conditions.
5.9The Customer using the Services shall comply with the requirements of Malaysian law, including but not limited to the Content Code. Digi will have the right to suspend/ bar and or terminate the Customer access to the Services in the event the Customer contravenes the said requirements.
5.10By using the Services, the Customer agrees to be bound by these Terms and Conditions.
Special Terms and Conditions
1.Subscribers who are under the Digi Mobile employee rate plan ("Employee") (including Customers who are under the Digi Mobile employee supplementary rate plan), are allowed to use the MobileTV™ Service.
2.Distributors, dealers, music publishers and advertising agencies (and their immediate families) of Digi including the other companies within the Digi group are allowed to use the MobileTV™ Service
3.This service is only applicable for Digi customers only.
4.The cost of using the service is from RM0.50 - RM4 per month on the various service packages that are available and is chargeable on a monthly basis, which will be billed into your monthly official bill statement. For Digi Prepaid customers, the cost will be deducted automatically from your Account.
5.The layout, graphic display is phone dependant.
6.Digi reserves the absolute right to, at any time, change any aspect of the Service or any part of these Terms and Conditions without prior notice.
7.You hereby agree that Digi shall not be liable in any manner whatsoever to the Customer or any other party for any losses or damages of any kind whatsoever suffered by a Customer or any other party as a result of this Service. In addition to these Terms and Conditions, instructions and methods of using this Service is set out here.
8.You shall NOT use the service and its content for commercial purposes or infringe the intellectual property rights of others.
9.You hereby agree that the services subscribed herein shall form part of the Services (as defined in the Agreement) and further agree to be bound by the terms and conditions of the Agreement.
10.You also hereby agree and acknowledge that Digi does not warrant that the Services shall be uninterrupted and error free.
