Draft Terms & Conditions
For purposes of these terms and conditions, the following terms shall be defined as follows:
“Subscriber(s)” – Digi Telecommunications Sdn Bhd’s ("Digi") new subscribers and existing subscribers of any prepaid plans except for Digi ABADI, Digi Monthly Plan 28 and Digi Monthly Plan 50;
“Offer” – Digi’s offer to a Subscriber to enjoy “Pakej Data Khas SPM dan STPM 2021” subject to the terms and conditions below.
1.1.This Offer is available from the 6th January 2021 and runs until 30th April 2021, both days included (“Offer Period”). Digi has the sole and absolute discretion to extend and/or vary the Offer and the Offer Period without prior notification.
1.2.Under this Offer, eligible Subscribers can purchase an internet pass of 15GB with a validity of thirty (30) days at Ringgit Malaysia Twenty (RM20.00) (collectively, “the Internet Plan”). The eligible Subscriber may purchase and re-purchase the Internet Plan for the duration of the Offer Period. If the eligible Subscriber re-purchases the Internet Plan while having existing data quota and validity from the Internet Plan, the existing data quota and validity shall reset to follow the new purchase.
2.1.The Offer is subject to eligibility as determined by Digi’s absolute discretion, and the terms and conditions below as may be changed from time to time without prior notice.
2.2.An eligible Subscriber:
2.2.1Subscriber must be of Malaysian Nationality, possessing a National Registration Identity Card (“NRIC”)
2.2.2Subscriber’s NRIC must indicate Subscriber’s age as being between sixteen (16) to twenty-two (22) years, both years included. In computing the age, the date of birth shall be included as a whole day, and the Subscriber shall be deemed to have met the age requirement on the beginning of the sixteenth (16th) anniversary from the date of birth, up until the day prior to the twenty-third (23rd) anniversary.
2.3.Each eligible Subscriber agrees that he/she has read and understood the terms and conditions of this Offer and by enjoying or accepting this Offer:-
2.3.1Agrees to be bound by the terms and conditions here;
2.3.2If the eligible Subscriber is below eighteen (18) years of age, he/she also confirms that prior consent from his/her respective parents or legal guardian to enjoy or accept this Offer. In the event the eligible Subscriber fails to provide Digi with the said parental or legal guardian consent upon request by Digi, such individual shall be subject to Clause 2.3.4 below;
2.3.3All personal details submitted when performing registration of this Offer must be accurate and complete and are subject to proof upon request by Digi; and
2.3.4Digi reserves the right, at any time, to verify the eligibility of the Subscriber and to disqualify any Subscriber for not complying with these terms and conditions or which tampers with the registration or Offer acceptance process. Digi shall have sole and absolute discretion to terminate, suspend or otherwise deal with the Subscriber and/or the Offer if incomplete, indecipherable, illegible, incorrect or fraudulent registrations or acceptances which violates these terms and conditions are discovered.
3.SIM Card Lifecycle
3.1.Upon activation of a SIM card, the status of the SIM card will be updated to an “active” status that will last for a thirty (30) day period. An “active” status means that the Subscriber is allowed to make outgoing and incoming calls or SMS or any type of services including Internet access.
3.2.If there is no ‘reload’ activity performed after the “active” state, notwithstanding any available credit balances still available in the SIM card, then a Subscriber will not be able to use or take advantage of any other available Digi services available for its prepaid Subscribers, but will only be able to receive incoming calls and SMS only.
3.3.If during the “active” state but before the end of the “active” state validity period, the Subscriber has utilised all the available credit balance, then the Subscriber will not be able to use any further Digi services, but should still be able to receive incoming calls and SMS as similarly stated above.
3.4.After the end of the thirty (30) days of an “active” status, if there is no ‘reload’, a grace period will apply for sixty (60) days. After which, the Subscriber is required to purchase the internet before the SIM card account is terminated.
3.5.The number of days given to the Subscriber to receive incoming calls and SMS is sixty (60) days upon expiry of “active” state validity period, but no outgoing transactions are allowed unless a 'reload' is performed.
3.6.Upon reaching sixty (60) days validity period, if there is still no reload activities performed, the status of the SIM card will be changed to 'Suspended (R2)' whereby a Subscriber will not be allowed to receive incoming or outgoing calls or SMS except for automated SMS from Digi.
3.7.Upon the following day of the ‘Suspended’ stage, the status of the SIM card will be changed thereafter to a 'Terminated' state and the Subscriber will not be able to obtain the same mobile number (MSISDN) or any remaining credit balance or any applicable freebies remaining in the SIM card.
4.1.All other supervening terms and conditions stipulated on the General Digi Prepaid service and/or the Digi Prepaid Mobile Internet plans will apply as amended from time to time and where applicable.
4.2.Digi shall not be responsible in any way in the event that the Offer was activated by a third party without his/her consent. Digi shall not refund nor compensate the Subscriber in any manner whatsoever in such situations.
4.3.This service is provided on an "as is" basis and Digi does not guarantee or warrant that there shall be no disruptions, defects or errors in the usage provided by this subscription and/or its offers. Digi shall not be responsible in any way whatsoever for the loss incurred directly or indirectly for such failure or any disruptions associated to the network in any way whatsoever.
4.4.By enjoying and accepting this Offer, the Subscribers acknowledge that they understand the terms herein and conditions as well as the General Terms and Conditions which are available on Digi’s website, including but not limited to the Privacy Notice, the Privacy Statement which are available on Digi’s website at https://www.digi.com.my/support/tnc/general/privacy-notice/privacy-notice-en, and agree to abide by it.
4.5.Digi reserves the right at its absolute discretion to vary, delete or add to any of these terms and conditions of this Offer, including but not limited to any feature of this Offer from time to time without prior notice as it deems fit. Continued use of the Internet Plan and/or service following any changes to these terms and conditions constitutes an acceptance to those changes (if any).
